The email address above is the direct and effective means of communication with the operator for the purposes of article 10.1.a) LSSI-CE. The operator is referred to below as “Inmoblia”.
2. Purpose and acceptance
This legal notice governs access to, browsing of and use of the website inmoblia.es and all of its subdomains and routes (the “Site”). Accessing the Site makes you a user and implies full acceptance of this legal notice, the Terms of use, the Privacy policy and the Cookie policy as published at any given time.
Anyone who does not accept these terms must refrain from using the Site.
3. Nature of the service
Inmoblia is an information and analysis service covering the Spanish residential market. It brings together housing adverts published by third parties and combines them with official public data sources in order to compute rental-yield indicators and market context by territory.
To avoid any confusion about the scope of the service, it is expressly stated that Inmoblia does not:
- act as an estate agency or as a real estate agent, nor carry out any brokerage, intermediation or marketing of property;
- take part in the negotiation, the execution or the payment of any transaction between buyer, seller, landlord or tenant;
- provide appraisal services or issue valuations with legal effect: estimated amounts are not appraisals for the purposes of Order ECO/805/2003, do not come from an appraisal company authorised by the Bank of Spain, and cannot be used as mortgage security or in inheritance, judicial or tax proceedings;
- provide investment, financial, tax, legal or technical advice, or make personalised recommendations;
- provide credit intermediation or loan comparison services within the meaning of Act 2/2009 and Act 5/2019 on real estate credit agreements;
- receive any commission from the agencies, developers or private individuals whose adverts are referenced.
4. Origin of the content
The Site combines three kinds of content, under different regimes:
- Third-party adverts. Property records are built from adverts published in a publicly accessible manner by estate agencies, developers and private individuals on their own websites. Every record identifies its source and links to the original advert. Inmoblia is not the advertiser, does not verify what the advertiser publishes and is not answerable for its content.
- Public-sector data. Territorial, cadastral, income, employment and auction indicators come from public bodies — including the Directorate-General for Cadastre, the INE, MIVAU (SERPAVI), the AEAT, the SEPE and the BOE auction portal — and are re-used under Act 37/2007 on the re-use of public sector information and the re-use conditions published by each body. Those bodies do not sponsor, endorse or take part in this service.
- Own content. Editorial texts, methodology, derived indicators, design, brand and software are Inmoblia's own work.
Property information is captured at a point in time and may no longer be current. The original advert on the advertiser's own site always prevails over what is published here. The procedure for requesting the correction or removal of content is set out on the Content removal page.
5. Intellectual and industrial property
The source code, design, navigation structure, editorial texts, calculation methodology, derived indicators, brand, logo and the selection and arrangement of the data set belong to Inmoblia or its licensors and are protected by Royal Legislative Decree 1/1996 (consolidated text of the Spanish Intellectual Property Act, “TRLPI”) and by industrial property law.
Inmoblia additionally holds the sui generis database maker's right over the collection it publishes, under article 133 TRLPI, by reason of the substantial investment made in obtaining, verifying and presenting it.
Distinctive signs, images and descriptive texts originating from third-party adverts belong to their respective owners and are reproduced to a limited extent, with the source stated and a link to the original, for the purpose of identifying the advert referenced.
Reproduction, distribution, public communication, transformation, or extraction and re-utilisation of a substantial part of the Site's content without prior written authorisation is prohibited, on the terms set out in the Terms of use.
6. Liability
Inmoblia answers for the diligence with which it produces and publishes its own content, but cannot and does not warrant:
- the accuracy, currency, completeness or availability of information originating from third parties or from public sources;
- that an advertised property exists, is available, matches its description, or can be acquired on the published terms;
- that estimated indicators will materialise: the future return of a property investment depends on factors no model can anticipate;
- uninterrupted operation of the Site or the absence of errors, viruses or harmful components.
Inmoblia is not liable for loss arising from the use of published information as the basis of an economic decision, nor for relationships the user enters into with third parties on the strength of a referenced advert. Nothing in this notice excludes liability that cannot lawfully be excluded, in particular towards consumers and in cases of wilful misconduct or gross negligence.
7. Links
The Site contains links to third-party sites — in particular to original adverts, to the Cadastre's electronic office and to public-body portals — for information and source-attribution purposes. Inmoblia does not control those sites and assumes no responsibility for their content, policies or practices. A link does not imply any relationship, sponsorship or endorsement.
Linking to the Site is free, provided the link points to the home page or to a complete content page, does not reproduce the Site inside a frame, does not create confusion as to ownership and is not accompanied by false or disparaging statements.
8. Changes and availability
Inmoblia reserves the right to alter the presentation, configuration and content of the Site at any time, and to suspend its provision temporarily or permanently for technical, maintenance or business reasons.
Amendments to this legal notice take effect on publication. The date of the version in force appears at the foot of this page.
9. Governing law and jurisdiction
This legal notice is governed by Spanish law. Any dispute arising from access to or use of the Site shall be submitted to the courts of the operator's domicile, unless the user is a consumer, in which case the forum granted by mandatory consumer protection rules applies, in particular that of the consumer's own domicile.
