1. Purpose and acceptance
These terms govern use of the site inmoblia.es and the services it offers: browsing the property catalogue, investment reports, territorial guides, the indicative valuation tool and editorial content. Using the Site implies acceptance of them.
The service is provided from Spain and is aimed at an audience interested in the Spanish residential market.
2. Access to the service
Access to the Site is free of charge and requires no registration. The user bears the connection and equipment costs needed to access it.
Inmoblia may in future offer features requiring a user account. In that case, anyone registering must provide truthful information and keep it up to date, safeguard their credentials and report any unauthorised use without delay. Credentials are personal and non-transferable. An account may be closed at any time free of charge, with consequent deletion of the associated data on the terms of the Privacy policy.
3. Permitted use
The user may consult, read, print and share links to the Site's content for personal, professional or informational use, including quoting specific figures with the source stated and a link to the originating page.
4. Prohibited use
The following are expressly prohibited:
- extracting or re-utilising, by automated crawling or any other means, all or a substantial part — assessed quantitatively or qualitatively — of the Site's content, as well as the repeated and systematic extraction or re-utilisation of insubstantial parts amounting to acts conflicting with the normal exploitation of the database, under article 133 TRLPI;
- reproducing, distributing or publicly communicating the Site's content for commercial purposes, or incorporating it into another product or service, without prior written authorisation;
- using the Site's content to train, fine-tune or evaluate artificial intelligence models — a reservation of rights expressly made for the purposes of article 4 of Directive (EU) 2019/790 and the Spanish legislation transposing it;
- circumventing or attempting to circumvent technical protection measures, usage limits, authentication mechanisms or access restrictions;
- taking any action liable to damage, overload or degrade the operation of the Site or its infrastructure;
- introducing malicious code, or using the Site for unlawful or fraudulent activities or activities harmful to third-party rights;
- removing or altering authorship, source or ownership notices, or presenting content in a way that misleads as to its origin.
Breach entitles Inmoblia to block access, without prejudice to any legal action that may be appropriate.
5. Accuracy of the information
The Site shows information gathered from third-party adverts and public sources at a point in time. An advert may have changed price, been withdrawn, or been sold or let since it was last read, and a public source may publish later revisions of its series. Every record states the date of the information and links to the original advert, which prevails in the event of any discrepancy.
Users must verify any relevant figure directly with the advertiser and with official sources before making a decision, and inspect the property themselves or through professionals.
6. No advice
Estimates of yield, value, mortgage cost, taxes or recurring expenses are computed using general models and assumptions that may not fit the specific circumstances of a property or a person. Property investment carries risks, including loss of capital, illiquidity, void periods, non-payment and regulatory or tax changes. Past or estimated returns do not guarantee future returns.
7. Intellectual property
The intellectual and industrial property regime of the Site is the one described in the corresponding clause of the Legal notice. Anyone who believes that published content infringes their rights may follow the procedure on the Content removal page.
8. Availability and changes to the service
The service is provided as available, with no service-level commitment. Inmoblia may add, change or remove features, and suspend or discontinue the service for maintenance, security or business reasons, endeavouring to announce foreseeable interruptions in advance.
These terms may be amended. The version in force is the one published on this page, bearing the date shown at its foot; substantial changes will be announced prominently on the Site.
9. Liability
Inmoblia is liable for loss it causes wilfully or negligently, to the extent required by law. It is not liable for loss arising from economic decisions taken on the basis of published information, from the conduct of advertisers or third parties, or from interruptions or errors beyond its control.
No clause of these terms limits or excludes rights granted to a user who is a consumer by mandatory law, or liability that cannot lawfully be excluded.
10. Consumers and dispute resolution
A user who is a consumer benefits from Royal Legislative Decree 1/2007, approving the consolidated text of the General Act for the Defence of Consumers and Users.
Any complaint may be sent to inmoblia@sha3.dev and will be dealt with as promptly as possible. As at the date of this version, Inmoblia is not a member of any out-of-court consumer dispute resolution scheme; this does not prevent a consumer from turning to the competent consumer authorities or to the courts.
11. Governing law and jurisdiction
These terms are governed by Spanish law. Disputes shall be heard by the courts of the operator's domicile; if the user is a consumer, the forum granted by the applicable mandatory rules applies, in particular that of the consumer's own domicile.
